Article 1 — Preamble

These Terms of Use ("ToU") govern access to and use of the Aria CEO service, published by Thomas Taggae, accessible via ariaceo.com.

Article 2 — Definitions

• Service: Aria CEO application and all its modules (AI, content generation, intelligence, analytics, planning, automations).
• User: any adult natural person using the Service.
• Account: secure personal space granting access to the Service.
• Content: any text, image, video, data provided to or generated by Aria.
• Third-party platform: Instagram, Facebook, TikTok, LinkedIn, YouTube, Google, Apple or any other service connectable via OAuth.
• Aria: proprietary marketing intelligence of Aria CEO. Underlying technical models are an internal implementation detail.

Article 3 — Service access

The Service is accessible 24/7, subject to maintenance and force majeure. Access requires creating an Account, an active subscription (free Discovery plan included), internet connection and compatible device.

Article 4 — Account creation

To create an Account, the User must:

• Be of legal age (18+)
• Provide accurate, up-to-date information
• Create a secure password (8 characters minimum)
• Accept ToS, ToU and Privacy Policy

The User is solely responsible for the confidentiality of their credentials.

Article 5 — Acceptable use

Strictly prohibited:

• Generating or distributing illegal, hateful, defamatory, pornographic, discriminatory content or content harmful to others
• Spam, phishing, unsolicited bulk sending
• Attempts to circumvent quotas (fraudulent multi-accounts, unauthorized scripts)
• Reverse engineering, extraction or copying of AI models
• Use to develop a competing service
• Reselling or redistributing the Service
• Identity theft of third parties
• Violation of connected platforms' Terms

Article 6 — Third-party platform connection (OAuth rules)

6.1 Meta / Instagram / Facebook

You commit to comply with Meta Terms, Instagram Terms, Community Standards and Meta Developer Platform Terms. Aria CEO does not publish any content on your behalf without prior validation, and respects frequency limits imposed by Meta to avoid spam flagging.

6.2 TikTok

Compliance with TikTok Terms, Community Guidelines and TikTok Developer Terms.

6.3 Google / YouTube

Google Terms, YouTube Terms, Google API Services User Data Policy (including Limited Use requirements).

6.4 LinkedIn

LinkedIn User Agreement, Professional Community Policies, LinkedIn API Terms of Use.

6.5 Access revocation

You may revoke Aria CEO's access at any time, from your Aria CEO account (Integrations) or each third-party platform settings (Connected apps). Revocation triggers immediate deletion of OAuth tokens (within 24h maximum).

Article 7 — Content generated by Aria

Contents generated by Aria from User-provided information:

• Are the User's property upon generation
• Are provided "as is" without guarantee of commercial results
• Must be reviewed, validated and adapted by the User before publication
• Remain under the User's editorial and legal responsibility

The User is responsible for:

• Truthfulness and accuracy of published information
• Respect for image rights and intellectual property
• Compliance with Influencer Law (#ad, #partnership disclosures)
• Sector-specific mandatory mentions (cosmetic INCI, food allergens, health MA mentions)
• Transparency obligations regarding AI use in content creation (EU AI Act)

Article 8 — Limits and quotas

Each plan includes monthly or daily quotas (details on Pricing page). Exceeding triggers: in-app notification, temporary feature suspension until next cycle, possibility to upgrade or add an add-on.

Article 9 — Availability and maintenance

The Publisher aims for 99% monthly availability. Maintenance operations may cause interruptions, announced 48h in advance when possible.

Article 10 — Intellectual property

All Service elements (interface, code, proprietary AI models, "Aria CEO" trademark, logo) are the exclusive property of the Publisher. The subscription grants only a non-exclusive personal usage right during the subscription period.

Article 11 — Suspension and termination

The Publisher may suspend or terminate an Account without notice in case of: ToU/ToS violation, fraudulent/illegal/abusive use, persistent non-payment, illegal content generation, formal complaint from a third-party platform, manifest violation of Community Guidelines of connected platforms.

Article 12 — Liability

Aria CEO is a decision-support tool. The Publisher cannot be held liable for User decisions made on the basis of generated content/analysis, commercial/marketing results, content published on third-party platforms, interruptions caused by providers (Stripe, Supabase, social platforms), data losses caused by the User, sanctions imposed by a third-party platform following User violation of its Terms.

Article 13 — Personal data

Data processing is governed by the Privacy Policy.

Article 14 — ToU modifications

The Publisher may modify the ToU. Users will be notified by email at least 30 days before entry into force. Continued use beyond this period constitutes acceptance.

Article 15 — Governing law

The ToU are governed by French law. Any dispute will be submitted to competent French courts after attempted prior mediation.
